EAM Jaishankar Addresses US Deportation Of Indian Nationals, Emphasizes Legal Mobility

New Delhi (India), February 6: External Affairs Minister S. Jaishankar on Thursday addressed the issue of the deportation of Indian nationals by the United States, stating that it is the obligation of all countries to take back their nationals if they are found living illegally abroad. Jaishankar highlighted that the Indian government is actively engaging with the US to ensure that deportees are not mistreated during their return.

Speaking in the Rajya Sabha, Jaishankar explained that deportations by the US are carried out by the Immigration and Customs Enforcement (ICE) authorities, following the standard operating procedures (SOPs) which have been in place since 2012. He clarified that these procedures have not changed, with deportees, including women and children, being treated according to the established protocols. While restraints are used during deportations, they are removed when needed, such as during toilet breaks or in case of medical emergencies.

“The US authorities have confirmed that women and children are not restrained during deportation, and all needs of the deportees, including food, medical assistance, and other necessities, are attended to,” Jaishankar said, adding that the Indian government is engaging the US to ensure that deportees are treated respectfully during their transit. He emphasized that the focus should be on cracking down on the illegal migration industry while facilitating legal migration.

Jaishankar also pointed out that illegal migration often leads to criminal activities, and the people involved are vulnerable to exploitation and inhumane conditions. He noted that illegal migrants have testified to their traumatic experiences, and some have tragically lost their lives in the process.

The Minister reiterated that all countries must take back their nationals who are found living illegally within their borders, subject to proper verification of their nationality. “This is not a policy unique to any one country, but a generally accepted principle in international relations,” Jaishankar said.

Providing a historical context, Jaishankar listed the number of deportations from the US to India since 2009, revealing that the deportations have been occurring for several years. The numbers have varied over the years, with 104 deportees arriving from the US on a flight in February 2025.

A US Embassy spokesperson had earlier stated that the United States is rigorously enforcing its immigration laws, sending a strong message that illegal migration is not worth the risk. The spokesperson emphasized that the deportations are part of the US’s ongoing efforts to tighten border security.

Jaishankar concluded by calling on both nations to focus on encouraging legal mobility and ensuring that illegal migration is discouraged, for the benefit of both countries and the individuals involved.
