NEW DELHI — The legal showdown over the late industrialist Sunjay Kapur’s massive inheritance has reached the Supreme Court of India. His third wife, Priya Kapur, has reportedly approached the apex court to gain access to confidential documents from Sunjay’s 2016 divorce from Bollywood star Karisma Kapoor.

The move is seen as a strategic attempt to map out previous financial settlements as she faces a fierce challenge from Sunjay’s children, Samaira and Kiaan Kapur, who are contesting the authenticity of their father’s will.


1. Seeking the Karisma-Sunjay Divorce Files

According to ANI, Priya Kapur has requested certified copies of all records related to the 2016 divorce proceedings held in Mumbai.

  • The Objective: Priya is reportedly seeking to understand the exact nature of the financial settlements and child custody arrangements finalized a decade ago.
  • The Bench: A bench led by Justice AS Chandurkar is set to decide if these private matrimonial records can be released to a third party, even if that party is the legal widow.

2. The “Digital Trail” Discrepancy

The core of the dispute rests on a contested will allegedly executed on March 21, 2025. Samaira and Kiaan Kapur have presented evidence to the Delhi High Court that they claim exposes a major lie in Priya Kapur’s testimony.

  • The Alibi: Priya Kapur filed an affidavit stating she was in Gurugram on March 21, 2025, to witness the signing of the will.
  • The Evidence: Electronic records and cell tower pings reportedly place Priya’s mobile phone in New Delhi on that exact date.
  • The WhatsApp Factor: The children further claim that Sunjay Kapur was in Delhi that day—not Gurugram—as he was actively messaging Karisma Kapoor on WhatsApp to discuss acquiring Portuguese citizenship for Samaira and Kiaan.

“When an affidavit clashes with electronic evidence, courts become extremely cautious,” noted Advocate Swapnil Kothari. “Even a single inconsistency can lead to a re-examination of the larger narrative.”


3. Allegations of a Fabricated Will

The siblings have moved beyond civil litigation, seeking criminal action against Priya Kapur under Sections 338 and 340 of the Bharatiya Nyaya Samhita (BNS) for alleged forgery and perjury.

Questionable Elements in the Contested Will:

  • Spelling & Grammar: Filings point to glaring spelling mistakes and the incorrect use of pronouns for Sunjay Kapur (the testator).
  • Execution Loopholes: The children allege the document was fabricated post-mortem to systematically exclude them from the ₹30,000 crore estate.
  • Inconsistencies: Internal contradictions within the text of the will have led legal experts to question if it was drafted by Sunjay Kapur at all.
