Karishma Kapoor’s Children Challenge Sunjay Kapur’s Will, Allege Fabrication

New Delhi: Karishma Kapoor’s children, Samaira (20) and Kiaan (15), have questioned the authenticity of late businessman Sunjay Kapur’s will in the Delhi High Court, alleging it is “fabricated” and contains “glaring blunders.”

Sunjay Kapur, former chairperson of Sona Comstar, passed away on June 12 at age 53 from a heart attack while playing polo in London. He was previously married to Karishma Kapoor, with whom he had Samaira and Kiaan, before marrying Priya Kapur and having a son, Azarius.

Represented by senior advocate Mahesh Jethmalani, the children urged a bench of Justice Jyoti Singh to restrain Priya from creating third-party rights in Sunjay’s estate. They contended that the will, which allegedly leaves Sunjay’s entire estate to Priya, was drafted under “suspicious circumstances” and without Sunjay’s involvement.

Jethmalani highlighted several inconsistencies in the will:

Azarius’s name was misspelt multiple times.

Samaira’s address was listed incorrectly.

Absence of a schedule of assets, including key properties, a 2010 family trust, and holdings in jewellery, artwork, and precious metals.

Contradictory listing of bank accounts in different sections.

“The will is a work of art and has no involvement of Sunjay. This will ex facie should be cast into the dustbin of history. The address of his daughter here is mentioned wrongly… How can he have written his daughter’s address wrong and misspelt his son’s name in multiple places? It demeans Sunjay Kapur,” Jethmalani submitted.

The children’s suit seeks a 1/5th share in their father’s estate, claiming that Priya Kapur presented the alleged will for the first time at a family meeting on July 30. They further alleged that Priya, along with the witnesses Nitin Sharma and Dinesh Agarwal, conspired to create a forged will.

Jethmalani also pointed out that the will was stored on Nitin Sharma’s device, last modified on March 17, when Sunjay was traveling from Goa to Delhi. Following Sunjay’s death, Nitin Sharma was made a director in Aureus Investment Private Limited (APIL), a promoter entity of Sona Comstar.

“There was no lawyer to draft the will; it was attested by layman witnesses, one of whom was later obliged and rewarded. This is a will which Sunjay Kapur has not signed, prepared, or read,” Jethmalani added.

Earlier, Jethmalani had accused Priya of acting like a “greedy Cinderella stepmother,” rushing to appropriate Sunjay’s assets following his demise.

The matter is scheduled for further hearing on Tuesday, with arguments from Priya Kapur’s lawyer expected to commence.
