New Delhi [India], February 15: Delhi Police informed the Rouse Avenue court on Saturday that it will file a chargesheet against two accused, Rohit alias Anna and Sachin Chikara, arrested in connection with a case under the Maharashtra Control of Organized Crime Act (MCOCA) linked to gangster Kapil Sangwan alias Nandu. The chargesheet will be filed by February 24.
The accused duo, Rohit and Sachin, have been in judicial custody since their arrest in November 2024. Former AAP MLA Naresh Balyan was also arrested in connection with the same case on December 4, 2024, and remains in custody.
Meanwhile, the court has reserved its order on the cognizance of the charge sheet filed against another accused, Ritik alias Peter, for February 24. Ritik, along with Rohit and Sachin, is allegedly part of an organized crime syndicate led by gangster Kapil Sangwan, who is currently absconding.
After hearing submissions from Special Public Prosecutor (SPP) Akhand Pratap Singh, Special Judge Kaveri Baweja directed him to submit a short note on cognizance within two days. The court will consider the charge sheet against Ritik on the next date of hearing.
During the proceedings, SPP Akhand Singh presented evidence against Ritik Peter, including his statement under MCOCA and statements from witnesses. Singh submitted that Ritik was involved in a firing incident at the office of JMD Builders in Mohan Garden, as well as in another firing in Najafgarh. The police had recovered a pistol used in the Mohan Garden firing, and forensic evidence confirmed it was the same weapon used in the extortion attempt at JMD Builders.
The prosecution also mentioned a statement from the victim, who stated that Ritik had given Rs 10 lakh to an aide of Kapil Sangwan and Rs 1 lakh earlier. Delhi Police confirmed that cognizance had already been taken in the Mohan Garden case.
Ritik’s statement under Section 18 of MCOCA was also voluntarily given to the DCP. In response to the court’s query about a possible retraction of his statement, Delhi Police clarified that Ritik had not claimed that his statement was taken under duress. The issue of retraction would be addressed during the trial stage.
The Delhi Police had filed a charge sheet against Ritik under the sections of MCOCA on December 26, 2024. The charge sheet, spanning around 1,000 pages, was filed under Section 3 of MCOCA.
In a related development, AAP MLA Naresh Balyan, arrested on December 4, was remanded in judicial custody on December 13. His bail plea was rejected by the court, and the matter is now pending before the High Court.
