Delhi Court Denies Bail To Afghan National In Robbery And Injury Case

New Delhi (India), February 12: A Delhi court has recently denied bail to Omid Nazari, an Afghan national accused of robbery and causing grievous injury to the victim in a case filed at the Malviya Nagar police station.

Additional Sessions Judge (ASJ) Neha dismissed Nazari’s bail application after reviewing the submissions and the Medical Legal Case (MLC) of the victim. The court referred to established legal principles regarding bail in non-bailable offences, noting that such decisions are based on the facts and circumstances of each case.

“The law regarding bail has been settled through various judgments of the Supreme Court and Hon’ble High Court. In case of non-bailable offences, it is the discretion of the Court depending upon the facts and circumstances of the case,” the court stated in its order. “The allegations against the accused are serious, and therefore, the Court is not inclined to grant bail to accused Omid Nazari. The bail application is, therefore, dismissed,” ASJ Neha ruled on February 4.

The court also considered the MLC of the victim, who suffered significant injuries, including a fracture in his finger. The report noted bruises on his forehead, a laceration on his upper lip, and abrasions on his left elbow. These injuries were deemed grievous by the attending doctor. The victim was also robbed of his purse, containing Rs. 8,000, along with his driving license and Aadhar card during the incident.

According to the charge sheet filed by Delhi police, the incident occurred on October 20, 2024, around 3 am. The victim was on his scooter heading to a nearby store to buy medicine when he was stopped by two Afghan nationals. After an initial exchange of words, the accused allegedly attacked the victim, attempting to steal his gold ring and subsequently robbing him.

The defense counsel for the accused argued that the complainant had fabricated the story, questioning why the victim was out at such an early hour. They also claimed that the accused and his co-accused, who had previously worked in a nearby shop, had been struggling financially as the shop had been closed for two months.

Despite these arguments, the court emphasized the severity of the charges against Nazari and dismissed his bail request. The accused has been in judicial custody for more than 75 days since the incident.
