Congress To Challenge Constitutionality Of Waqf Amendment Bill 2025 In Supreme Court, Says Jairam Ramesh

Congress MP and Party General Secretary (Communications) Jairam Ramesh on Friday announced that the Congress party will soon move the Supreme Court to challenge the constitutionality of the Waqf Amendment Bill 2025, which was passed in Parliament during the early hours of the same day.

In a post on X (formerly Twitter), Ramesh shared that the Congress is already pursuing several legal challenges in the Supreme Court and will soon include the Waqf Amendment Bill in its list of active litigations.

“The INC’s challenge of the CAA, 2019, is being heard in the Supreme Court. The INC’s challenge of the 2019 amendments to the RTI Act, 2005, is being heard in the Supreme Court. The INC’s challenge to the validity of the amendments to the Conduct of Election Rules (2024) is being heard in the Supreme Court. The INC’s intervention to uphold the letter and spirit of the Places of Worship Act, 1991, is being heard in the Supreme Court. The INC will very soon be challenging in the Supreme Court the constitutionality of the Wakf (Amendment) Bill, 2024,” Ramesh said.

He further underscored the party’s determination to defend the constitutional framework of the country against what it views as overreach by the Modi government.

“We are confident and will continue to resist all assaults of the Modi Government on the principles, provisions, and practices that are contained in the Constitution of India,” he added.

The Waqf Amendment Bill 2025 was passed by both Houses of Parliament after extended and intense debates. The Rajya Sabha passed the bill with 128 votes in favor and 95 against, with Chairman Jagdeep Dhankhar announcing the result in a post-midnight session. The Lok Sabha had passed the bill earlier, also following a marathon discussion.

The revised bill was introduced after incorporating recommendations of the Joint Parliamentary Committee, which had reviewed the original draft introduced in August 2024. It seeks to amend the Waqf Act of 1995, focusing on better administration and management of Waqf properties across India.

The amendments aim to enhance the efficiency of Waqf Boards, streamline the registration process, and integrate technology for better management of Waqf records.
