Lucknow (Uttar Pradesh) [India], April 20: Congress leader Shama Mohammed has called on Chief Justice of India Sanjiv Khanna to initiate contempt proceedings against BJP MP Nishikant Dubey for his controversial remarks targeting the judiciary. She warned that failure to act could encourage others to make similar attacks in the future.
“MP Nishikant Dubey is accusing CJI Sanjiv Khanna of being responsible for civil unrest in the country and claimed the judiciary is inciting religious issues,” Shama Mohammed told. “This is a direct attack on the Constitution. What action will the CJI take? Will there be a contempt case?”
She emphasized that such statements undermine the democratic fabric and judicial independence. “If action isn’t taken now, more people will start targeting the judiciary and justice system. The BJP must take responsibility and expel Dubey from the party,” she said.
Dubey sparked outrage on Saturday when, in response to a media query, he appeared to blame CJI Khanna for “all civil wars happening in this country.” He further criticized the judiciary’s role in recent political decisions, particularly referencing the Supreme Court’s verdict on the Tamil Nadu Governor’s decisions.
“You want to dictate Parliament? The President appoints the CJI. Parliament makes the law. In which law is it written that the President must act within three months? This is leading the country toward anarchy,” Dubey said.
He also invoked Article 368 of the Constitution, asserting that only Parliament has the right to make laws, while the judiciary is limited to interpreting them.
Facing backlash, BJP President JP Nadda swiftly distanced the party from Dubey’s statements. “The BJP has always respected the judiciary and completely rejects the remarks made by Nishikant Dubey,” Nadda stated.
