“Attack on Judiciary and Constitution”: Harish Rawat Demands Nishikant Dubey’s Expulsion Over SC Remarks

Congress leader Harish Rawat accuses BJP MP Nishikant Dubey of attempting to intimidate the judiciary; says BJP shielding unconstitutional elements in Waqf Act and eroding public faith in courts.

Senior Congress leader and former Uttarakhand Chief Minister Harish Rawat on Sunday lashed out at BJP MP Nishikant Dubey for his controversial remarks against the Supreme Court, calling them a direct assault on India’s judicial system and constitutional values.

In a strong-worded statement to ANI, Rawat said Dubey’s comments, made after the apex court stayed certain provisions of the Waqf (Amendment) Act, reflect an effort to terrorise and undermine the judiciary.

“This is an attack on the entire judicial system, an attack on the Constitution itself. They are targeting the Chief Justice and other judges, operating like a political squad to create fear in the judiciary,” said Rawat.


⚖️ BJP Fears Unconstitutional Flaws in Waqf Act, Says Rawat

Rawat also claimed that the BJP’s aggressive posture stems from an awareness that the Waqf Amendment Act contains unconstitutional elements, and fears judicial scrutiny could expose them.

“They know the amendments will not stand legal test. That’s why they are targeting the courts,” he added.


🧨 Dubey’s Explosive Comments on Supreme Court

Nishikant Dubey recently accused the Supreme Court of “inciting religious wars” and overstepping its jurisdiction, suggesting that the Parliament should be shut if courts are to decide on all matters.

He went on to criticize the court’s past decision on decriminalising homosexuality, stating that “one fine morning, the Supreme Court abolished the law,” and accused it of driving the country towards “anarchy.”

“The top court has only one aim: ‘Show me the face, and I will show you the law.’ If everything is to be decided by the court, then shut down Parliament and state assemblies,” Dubey said.


🚫 “Expel Dubey If BJP Is Honest”: Rawat

Slamming BJP President JP Nadda’s response—who called Dubey’s remarks personal views and rejected them—Rawat said such statements cannot be brushed off.

“If Nadda ji really means what he tweeted, then Nishikant Dubey must be expelled. Otherwise, it’s just a cover-up to protect someone who openly challenges the judiciary,” Rawat demanded.


🧾 BJP Distances Itself, But Questions Remain

BJP President JP Nadda issued a public clarification stating:

“These are their personal statements, and the BJP does not support them. We completely reject them.”

However, opposition parties and legal experts continue to question why no disciplinary action has been taken against Dubey and other BJP leaders who make incendiary statements targeting constitutional institutions.
